Areakart Shipping Policy
1. General Provisions & Scope of Applicability
Areakart serves exclusively as a technological intermediary facilitating the seamless integration of store owners with third-party rider services for the execution of deliveries. While Areakart provides the platform for operational efficiency, it neither assumes nor undertakes any legal, financial, or contractual obligation with respect to the delivery, fulfillment, security, or timely execution of any order transacted via its ecosystem.
Any engagement between merchants, customers, and rider service providers is undertaken at their own risk, and Areakart shall, under no circumstances, be deemed accountable for delays, disruptions, non-fulfillment, or consequential damages arising from the delivery process. However, in instances where Areakart’s intervention may aid in dispute resolution, Areakart may, at its sole discretion, facilitate communication between involved parties without assuming direct liability.
2. Shipping Policy for Merchants (Store Owners & Vendors)
-
Rider Allocation & Non-Guarantee of Availability
- Merchants acknowledge that the rider assignment function on the Areakart platform operates on an availability-dependent basis. Areakart does not guarantee the availability of riders at any given time.
- In scenarios where no rider is assigned due to high demand, service congestion, adverse weather conditions, or any reason beyond the scope of Areakart’s operational control, the store shall remain responsible for either reattempting assignment or arranging an alternative method of delivery at its sole discretion and risk.
-
Liability for Goods in Transit & Risk Assumption
- Once a package is transferred to a rider, Areakart disclaims all liability concerning the condition, integrity, or security of the package during transit.
- Any instance of theft, misplacement, destruction, tampering, or undue delay on the part of the rider shall be deemed a matter between the store and the respective delivery provider, and Areakart shall bear no fiduciary or compensatory responsibility for such occurrences.
-
Rider Misconduct, Extortion, or Unapproved Charges
- Should a rider demand unauthorized additional charges, refuse service without reason, or engage in any form of financial or operational misconduct, merchants are advised to decline such requests and escalate the matter directly to the respective rider service provider.
- Areakart may assist in relaying the issue to the concerned entity purely as a goodwill effort, but shall not be held accountable for the resolution, reimbursement, or restitution of losses incurred.
-
Cost Deductions & Financial Implications
- The fees associated with rider services, including but not limited to base delivery fees, peak-hour surcharges, reattempt fees, and cancellation penalties, shall be automatically deducted from the store’s total payable amount prior to disbursal.
- Areakart shall not entertain disputes arising from rider service pricing, discrepancies in fare calculations, or post-delivery adjustments, as these are solely determined by the rider service providers.
-
Force Majeure & Accidental Loss
- In cases where a rider is involved in an accident, sustains injury, or incurs vehicle breakdown, any consequential loss, damage, or financial claim shall be exclusively managed between the merchant and the third-party rider service.
- Areakart shall not provide any form of indemnification or legal backing for such incidents.
3. Shipping Policy for Customers
-
Non-Assurance of Delivery Timelines
- While Areakart provides estimated delivery durations, these are purely indicative and subject to variables such as traffic congestion, rider availability, climatic conditions, and service disruptions.
- Areakart disclaims liability for delivery delays, and customers shall not be entitled to compensation, reimbursement, or claims arising from such delays.
-
Obligations Concerning Address Accuracy & Rerouting Charges
- Customers are solely responsible for ensuring the correctness of the provided delivery address.
- In cases where the rider reaches an incorrect address due to customer error, the customer shall bear the responsibility of either:
a) Traveling to the incorrect address to retrieve the order, or
b) Paying any additional fare incurred by the rider for rerouting to the correct location.
- Areakart is not liable for any additional fees, cancellations, or delays caused by inaccurate address entry.
-
Package Loss, Damage, or Theft
- Customers must inspect the package immediately upon receipt. Any concerns regarding missing or incorrect items should be addressed directly with the merchant, as Areakart does not intervene in product-related disputes.
- Areakart does not hold financial accountability for lost, stolen, or damaged goods once they are in the rider’s possession.
-
Rider Payment Disputes
- If a rider demands extra charges or refuses to deliver without additional compensation, customers are advised to refuse such payments and report the issue directly to the respective rider company.
- Areakart may assist in forwarding complaints to the relevant authorities without assuming responsibility for the resolution.
4. Shipping Policy for Integrated Rider Services
-
Service Availability & Operational Constraints
- Areakart does not own, manage, or control any of the integrated rider services and cannot ensure continuous availability, delivery quality, or adherence to timelines.
- The non-assignment or unavailability of a rider shall not constitute grounds for financial compensation or liability against Areakart.
-
Financial Obligations & Payment Disputes
- All fees, surcharges, penalties, and associated rider costs are independently determined by the third-party service providers.
- Areakart shall not mediate, adjust, or entertain disputes relating to rider pricing, fare modifications, or unauthorized extra charges.
-
Accidents, Damage, & Legal Non-Accountability
- In the event that a rider sustains an injury, damages the package, or is involved in an accident during delivery, Areakart shall not be held liable for any claims, compensatory demands, or legal repercussions.
- Any such matters shall be handled exclusively between the store, customer, and the rider service provider.
5. Final Disclaimer & Limitation of Liability
By engaging with the Areakart platform for delivery-related services, all parties (including but not limited to merchants, customers, and rider service providers) explicitly acknowledge and accept that:
- Areakart functions purely as a digital intermediary and does not directly participate in or oversee the execution of deliveries.
- All financial transactions, disputes, and claims arising from delivery execution shall be settled independently between the concerned parties without Areakart’s direct involvement.
- Areakart may offer guidance or assistance where feasible, but such efforts shall not be misconstrued as an admission of liability.
- Areakart reserves the right to amend, update, or modify this policy at its sole discretion, without prior notice or obligation to notify individual users.
